Direct Selling in Florida: Companies, Law, and Leaders
Florida is the third most populous state, with 23,462,518 residents on July 1, 2025. About 29 percent of residents are Hispanic, and about 32 percent of residents age 5 and older speak a language other than English at home. Plondo builds software for direct selling companies and runs a free placement service for leaders. This page covers where Florida companies sit, how state law treats business opportunities, and what the language mix means for a growing team.
Three big metros, three different markets
Florida does not have one center of gravity. Jacksonville is the largest city, with 1,009,833 residents in 2024. Miami is the city most people picture, and its metro holds 6,457,988 people, more than the Tampa Bay metro (3,424,560) and the Jacksonville metro (1,760,548) combined.
For a direct selling company, that spread matters. A team that recruits in Jacksonville talks to a different community than a team that recruits in Miami. Event planning, training schedules, and even the best hour for a live call can change from one end of the state to the other.
Plondo publishes a page for each of the three cities. Use this state page for the legal and statewide picture, and the city pages for local detail.

Florida business opportunity and pyramid laws
Florida Sale of Business Opportunities Act and pyramid sales scheme statute[2]
This is general information, not legal advice. Florida regulates the sale of a business opportunity when the buyer pays more than $500 and the seller makes one of four listed promises. Separately, section 849.091 treats a pyramid sales scheme as a lottery and makes taking part in one a first degree misdemeanor. A Florida attorney should review any plan before launch.

What the Florida rules say in plain terms
- Written disclosure timing (section 559.803)
- At least 3 working days before the buyer signs or pays, the seller gives a written disclosure document[3]
- Required cover statement (section 559.803)
- The cover sheet says the State of Florida has not reviewed or approved the opportunity and tells the buyer to see an attorney[3]
- Bond or security (section 559.807)
- Sellers who promise an income guarantee, refund, or repurchase must hold a bond, deposit, or letter of credit of not less than $50,000[4]
- Buyer remedy (section 559.813)
- A buyer may rescind within 1 year of signing when the seller makes misleading statements or skips required disclosures[5]
- Pyramid sales schemes (section 849.091)
- A plan where a person pays more than $100 for a benefit not mainly tied to bona fide consumer sales is declared a lottery[6]
- Prohibited acts penalty (section 559.815)
- Acts listed in section 559.809 are a felony of the third degree[11]
Language across the state
Nearly one in three Floridians age 5 and older speaks a language other than English at home. In the city of Miami the share is about 77 percent. For a company that wants to enroll distributors across the state, a translated back office and translated training are daily needs, not extras.
Miami also acts as a trade hub. The Beacon Council, the county economic development group, says Miami International Airport handles 80 percent of air imports and 70 percent of air exports for Latin America and the Caribbean. A company with a Latin American launch plan can find logistics partners and bilingual staff close to Miami.

Which direct selling companies are headquartered in Florida?
Plondo's directory lists eight: Tupperware (Orlando), The Real Brokerage (Miami), LPT Realty (Lake Mary), Bravenly Global (Seminole), Shaklee (Miami), Jeunesse Global (Altamonte Springs), MONAT Global (Doral), and It Works! (Palmetto). The directory is a working list, not a complete census of every Florida company.
Does Florida law name direct selling as an exclusion from the business opportunity act?
No. Section 559.801 lists three exclusions: small sales of ongoing businesses, not for profit sales demonstration items or training priced at $500 or less, and laundry equipment. Whether a direct selling plan falls inside the act depends on the price, the seller's promises, and the plan facts, so ask a Florida attorney.
How does Florida treat a pyramid sales scheme?
Section 849.091 declares a pyramid sales scheme to be a lottery. It describes a plan where a person pays more than $100 and gets a benefit that is not mainly tied to bona fide sales to consumers and is linked to bringing in others. Taking part or soliciting is a first degree misdemeanor.
How many Floridians speak a language other than English at home?
About 32.0 percent of residents age 5 and older, based on the Census Bureau's 2024 American Community Survey one year estimate. About 28.7 percent of Floridians are Hispanic or Latino. In the city of Miami the language share is about 77 percent.
